Dispute a Bylaw Ticket

The dispute process applies to most bylaw tickets issued by the District of Tofino, including those for parking, noise, business licences, and property-related infractions.

Parking tickets issued by Robbins Parking are not administered by the District and must be appealed directly through Robbins Parking.

To dispute a bylaw ticket, a dispute must be submitted using the form on this page. Disputes must be submitted within 14 days of receiving the ticket.

If an individual experiences difficulty submitting the online form, they may email Bylaw Services for assistance.

All disputed tickets are reviewed by a Screening Officer.

The role of the Screening Officer is to determine whether an alleged offence was committed. The Screening Officer does not consider the circumstances surrounding the offence.

If the Screening Officer determines that the offence did not occur, the dispute is resolved at this stage.

If the Screening Officer determines that the offence did occur and the individual is not satisfied with the decision, they may request an Adjudication Hearing.

The bylaw adjudication system allows regional governments to manage most bylaw violations at the local level rather than through the Provincial Court system.

During an adjudication process:

• Evidence may be presented orally, in writing, or electronically

• The adjudicator determines only whether the alleged offence was committed

• The circumstances of the offence are not considered

If an adjudicator determines that the contravention did occur:

• The individual is required to pay the set fine amount

• An additional $25 adjudication fee applies

An adjudicator’s decision is final and cannot be disputed.
